The HR Magazine article: Safer Separations, written by Johnny Lee, director of Peace at Work, an agency dedicated to violence prevention in the workplace, states, “Terminations and layoffs are the leading causes of workplace violence committed by employees. Being respectful of the terminated employee betters the chances that the employee will walk away without engaging in retaliatory behavior.”, Lee said. He provides tips for before, during and after a termination meeting.
Similarly, in POE’s screening reports on the employment and resident applications we process, POE attributes the source of information to “MANAGEMENT” or the “HR DEPARTMENT” or some other generic identifier.
The reason for this is to shield from the applicant the names of the individuals providing the references.
The FCRA allows the identities of individuals to be shielded and POE chooses to do so, for the protection of those individuals, especially those who provide adverse information.
We are all too familiar with the horror stories of former employees, terminated employees, disgruntled employees returning to the work site to harm former supervisors, bosses, etc.
The names of the individuals with whom we speak are documented in internal notes in our reports and are available to our clients upon request.
POEknows legally protecting contacts and sources is good business and Safer Business!
