The 2012 EEOC guidance prohibits employers from automatically excluding job seekers with criminal records and strongly recommends that, in addition to assessing each criminal record hit for job-relatedness and business necessity, employers give applicants the opportunity to explain the underlying conduct, the circumstances of the offenses and a picture of what has occurred with the applicant, since the conviction.
