Employers
Employers – If you intend to decline a prospective employee, due to a criminal record, be mindful of the EEOC recommended comprehensive Individualized Assessment (IA). You can conduct your own IA on the applicant or allow POEknows to do this in-depth, inexpensive IA and get the results back to you quickly.
An Individualized Assessment (IA) will give you an extensive examination of who your applicant is…TODAY, the journey it took to get from conviction to consideration and it helps you determine to what extent the criminal record should impact the current application.
The 2012 EEOC guidance prohibits employers from automatically excluding job seekers with criminal records and strongly recommends that, in addition to assessing each criminal record hit for job-relatedness and business necessity, employers give applicants the opportunity to explain the underlying conduct, the circumstances of the offenses and a picture of what has occurred with the applicant, since the conviction.
According to EEOC recommendations, this examination should include four steps:
- Inform the applicant that the employer intends to not hire, as a result of the criminal record
- Give the applicant an opportunity to challenge, explain or discuss the criminal record
- Consider other factors surrounding the criminal record (more on this later)
- Consider the relationship between the criminal record and the position being filled
